Heng Xin Law Office Successfully Holding the 2017 Maritime Law Spring Seminar and Shanghai Shipping Department Opening Cocktail
Heng Xin Law Office 2017 Maritime Law Spring Seminar and Shanghai Shipping Department Opening Cocktail Party were ceremoniously held at Pudong Shangri-La East Shanghai on 3 March 2017.
The Seminar started with the address by Mr. MQ Zhu, Senior Partner of Heng Xin Law Office. Over eighty public figures in the shipping industry from Shanghai, Dalian, Beijing, Hong Kong and some other places attended the Seminar. The attendees included representatives from shipping companies (say,Cosco Shipping and its container lines and energy transportation companies, HNA Shipping, Welton Hazz and C.M Shipping), P&I Clubs (say, American Club, Britannia, CPI, NOE, TT and UK), ship underwriters and service agencies (say, Huatai Insurance Agency & Consultant Service Beijing and Shanghai, CCIC, Donghai Marine Insurance, Huatai Property & Casualty Insurance, Lloyd’(Mr. MQ Zhu, Senior Partner of Heng Xin Law Office)(Mr. MQ Zhu, Senior Partner of Heng Xin Law Office)s Insurance China and PICC Shanghai), insurance brokers and surveyors (say, Haining, Andrew Liu、 Lockton、 Marsh、Trade-wind, AMA, Reasun and Ejoy), and maritime authorities(say, LISCR).

The Seminar focused on three topics with which the shipowners, P&I Clubs and insurance companies concern the most, i.e. oil pollution, impact of 2006 MLC on shipowners’ liability, and the civil and criminal liabilities that a shipowner may face after a collision accident.
In the Seminar, Mr. Wang Wei, Partner of Heng Xin Law Office gave the first speech on the topic of impact of latest development of law on liability for vessel-induced oil pollution damage. (Mr. Wang Wei, Partner of Heng Xin Law Office)In the speech, Mr. Wang Wei laid particular emphasis on the significant impact of latest development of law on liability for vessel-induced oil pollution damage, straightening out the complicated provisions of law on vessel-induced oil pollution, discussing the issues of joint and several liability, “relevancy” and “causation” in liability for oil pollution damage, and briefly introducing the potential impact of new amendments to penalty provisions of the Marine Environment Protection Law on the shipping industry.

Ms. Shen Xiaoping, Partner of Heng Xin Law Office, then gave a speech on impact of the Maritime Labour Convention (“MLC”) 2006 on Shipowner’s Liability. Ms. Shen Xiaoping offered new insight on crew’s personal injury claims by way of interpretation of relevant MLC provisions, and analysed the impact of the newly effective MLC amendments regarding financial security on shipowners’ liability. By her interpretation, Ms. Shen gave the attendants a comprehensive picture of the MLC which is newly effective in China.

Mr. Wang Hongyu who joined Heng Xin in 2017 as Senior Partner shared with the attendants the latest development of handling of collisions between merchant vessels and fishing vessels in Zhejiang waters. Mr. Wang Hongyu began with two major collisions between foreign merchant vessels and fishing vessels in Zhejiang waters he handled in 2016, analysed the civil, administrative and criminal liabilities that shipowners often face, and gave the attendants a direct view of the points to which attention should be paid in handling of such collisions.

In the following Q&A session, the attendants focused on the possible criminal liabilities that the crew may face in collision cases and had a heated discussion in this regard. Capt. Kai from Britannia HK generously shared Club’s experience in handling crew’s criminal liability in collision matters all over the world.

The Seminar came to a close upon nightfall. The party then moved to Suzhou Hall which overlooks the magnificant nightview of the Bund and celebrated the opening of Shanghai Shipping Department of Heng Xin Law Office. Outstanding figures from the shipping industry granted their presence at the cocktail party. Mr MQ Zhu introduced the service mottos held by Heng Xin shipping lawyers: solving problems for shipping companies, planning tactics to solve problems, and promoting communication between clients. Mr Wang Hongyu who joined Heng Xin at the beginning of 2017 also shared with the guests how he has best wishes for the future and holds similar understandings of offering service, and how he very much looks forward to working with friends and collegues with similar values to serve shipowners, P&I clubs and insurance companies.
